**General Terms and Conditions Atelier van Ooijen**

**1. GENERAL**
1.1 These General Terms and Conditions apply when you, as a consumer, business, or institution (Customer), make a purchase at Atelier van Ooijen or in the webshop of Atelier van Ooijen on the website [www.ateliervanooijen.art](http://www.ateliervanooijen.art) (Website).
The General Terms and Conditions are published on the Website and can be sent by email upon the Customer’s first request.
1.2 The Website and all content on the Website are owned by Atelier van Ooijen and protected by intellectual property rights, as is all work produced by Atelier van Ooijen. Copying and/or using the aforementioned content or work without permission is prohibited.

**2. THE OFFER**
2.1 The offer from Atelier van Ooijen is non-binding. Atelier van Ooijen reserves the right to modify the offer.
2.2 All images on the Website and in the webshop have been published with care and as accurately as possible. This does not guarantee that the images are exact representations of the work.
2.3 Obvious mistakes or errors in the offer do not bind Atelier van Ooijen.
2.4 Atelier van Ooijen is not liable for errors on the Website or in the webshop. Atelier van Ooijen reserves the right to update, modify, or correct information.
If the Customer makes a purchase based on an error on the Website or in the webshop, Atelier van Ooijen will inform the Customer as soon as possible, and the Customer has the right to cancel the purchase.

**3. AGREEMENT**
3.1 By making a purchase via the Website or webshop, the Customer and Atelier van Ooijen enter into an agreement, and the Customer accepts these General Terms and Conditions. The purchase confirms that the Customer has read these Terms.
3.2 The agreement is only established after Atelier van Ooijen confirms the purchase.

**4. PAYMENT**
4.1 Prices include VAT, excluding shipping costs.
4.2 Payment options are listed on the Website and in the webshop. Atelier van Ooijen reserves the right to change the Customer’s selected payment method prior to delivery if it is unavailable for any reason.

**5. DELIVERY**
5.1 Atelier van Ooijen executes the agreement with the utmost care. Delivery usually occurs within a period of 7 days unless stated otherwise on the Website or webshop, or unless expressly agreed otherwise. For paintings and Custom Made works, the delivery period agreed with the Customer applies.
5.2 If Atelier van Ooijen anticipates a delay, it will contact the Customer and make every effort to fulfill the agreement.
If delivery exceeds 20 working days, the Customer may cancel the purchase, after which Atelier van Ooijen will refund the price without liability for additional compensation.
5.3 Atelier van Ooijen is not liable for delays caused by third parties or circumstances beyond its control.

**6. RIGHT OF WITHDRAWAL**
6.1 After receiving the purchase, the Customer may cancel it without reason within 14 days. The reflection period begins the day after receipt.
The right of withdrawal does not apply to Customers acting in a professional or business capacity.
6.2 To exercise the right of withdrawal, the Customer must notify Atelier van Ooijen and return the product in its original condition and packaging, following Atelier van Ooijen’s instructions.
6.3 The right of withdrawal does not apply to paintings and Custom Made works created exclusively for the Customer.

**7. WARRANTY AND COMPLAINTS**
7.2 The Customer must report defects or incorrectly delivered products to Atelier van Ooijen by email within 5 working days of receipt.

**8. CHANGES TO THE TERMS**
8.1 The current General Terms and Conditions are published on the Website.
8.2 Atelier van Ooijen reserves the right to modify these Terms. Revised terms apply from the moment the Customer accepts them.

**9. DISPUTES AND APPLICABLE LAW**
9.1 Atelier van Ooijen aims to resolve disputes through mutual consultation.
9.2 Dutch law applies exclusively to agreements between the Customer and Atelier van Ooijen. The Dutch court has exclusive jurisdiction, even if the Customer resides outside the Netherlands.
